Terms of Service

This English version is a convenience translation; the Czech version prevails in case of any discrepancy.

These Terms of Service govern the conditions for using the Danito service (the “service”), operated by the founder of the Danito project, and the relationship between the provider and the user of the service. These relations are governed by Czech law, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, as amended.

Service description

Danito is a web application for keeping tax records (daňová evidence), intended for self-employed individuals. It does not keep accounts within the meaning of Act No. 563/1991 Coll., on Accounting. The service includes managing billing subjects, issuing invoices, recording expenses and platform income, support for the KH1 / VAT control statement, and other features listed on the homepage danito.cz.

The service is provided “as-is”. In the current version of the service there is no service-level agreement (SLA); however, the provider does its utmost to keep operation stable and secure.

Danito is a software tool; it does not provide tax or accounting advice and does not replace a tax adviser. The user files the submission themselves on the official portal of the Financial Administration (EPO) — the service only prepares the underlying documents for them. Values that the service prefills or suggests — in particular classifications (NACE code, tax regime, income or expense category) and data taken from public registers (tax office and its territorial branch, VAT registration, bank account) — are a non-binding suggestion based on the available data. The user reviews them before filing and, by submitting, adopts them as their own.

Pricing

The current tariff price list is shown on the homepage danito.cz. Prices are in Czech crowns (CZK) and are stated including VAT. Any changes to the price list will be announced at least 30 days before they take effect.

Payment and billing terms

Payments for paid tariffs are processed by the GoPay payment gateway (GOPAY s.r.o.). The subscription is set up as a recurring monthly payment: on the first payment the user authorizes a mandate on GoPay’s secured page, and subsequent payments are collected automatically each month. Prices are in CZK. The user receives a tax document for each payment. The subscription can be cancelled at any time; after cancellation no further payment is collected and access to paid features continues until the end of the paid period.

The Starter tariff is free of charge and requires no payment details.

Right to withdraw from the contract

As a consumer, the user has the right to withdraw from the contract within 14 days of its conclusion without giving any reason (Section 1829 of the Civil Code). The user sends the withdrawal in writing or electronically to hello@danito.cz. If, within this period, the user requested that provision of the service begin during this period (typically by activating a paid tariff), the user shall pay the provider a proportionate part of the price for the performance already provided.

Termination of the contract

The contract may be terminated at any time at the user’s instruction, namely:

  • By the user via the “Delete account” feature in the application or by e-mail to hello@danito.cz. Deleting an account is irreversible and takes place without undue delay — no dark patterns, no conditional questioning (“are you sure you want to leave?” as an obstacle), no re-targeting e-mails.
  • By the provider with a 30-day notice period in the event of a breach of these Terms of Service or for operational reasons.

After the contract ends, the provider enables a data export (invoices, subjects, expenses) in a machine-readable format before the account is hard-deleted, see the privacy policy.

Liability and limitations

The provider is liable for damage caused by gross negligence or intent. The provider is not liable for the user’s improper use of the service, for errors in accounting records caused by the user, for the tax authority’s tax decisions, or for outages caused by third parties (hosting provider, transactional e-mail supplier, etc.). The maximum amount of compensation is limited to the amount equal to the price paid by the user over the last 12 months of using a paid tariff; during the free access period this amount is zero.

The service primarily processes accounting records. The user is solely responsible for the accuracy and completeness of the data entered into the system as well as data adopted from prefilled values or from a suggested classification, and for fulfilling their tax obligations. The user files their tax return in their own name and on their own responsibility; the provider is therefore not liable for fines, penalties, late-payment interest, or other sanctions imposed on the user by the tax administration. The provider’s liability under the first paragraph of this article is not affected thereby.

Complaints procedure

The user submits a complaint about a defect in the service or incorrect billing by e-mail to hello@danito.cz. In the complaint the user describes the defect and states the remedy sought. The provider confirms receipt of the complaint without undue delay and resolves it no later than 30 days from when it was submitted, unless agreed otherwise with the user. If the complaint is justified, the provider provides a remedy — by fixing the defect, granting a reasonable discount, or refunding the proportionate part of the price for the period during which the paid service was unavailable. A complaint cannot be applied to defects caused by the user’s improper use of the service, to errors in accounting data entered by the user, or to outages caused by third parties beyond the provider’s control (see Liability and limitations).

Governing law

The contractual relationship is governed by Czech law. The courts of the Czech Republic have subject-matter and territorial jurisdiction to hear disputes. As a consumer, the user may turn to the Czech Trade Inspection Authority (www.coi.cz) for out-of-court dispute resolution.

Changes to the Terms of Service

These Terms of Service may be changed in the future — typically when paid tariffs are introduced, the scope of features changes, or further processors are involved. The provider will announce substantial changes to users by e-mail at least 30 days before they take effect. If the user disagrees with the new version, they are entitled to terminate the contract before the change takes effect without penalty.
